A child abuse charge against Brady Kiser was recommended by Chandler police, but was dismissed by Maricopa County Attorney Rachel Mitchell.
Emilie took a break from posting her regular social media content following Trigg’s death, with the mother returning to her TikTok account in recent months.
Below a recent daily vlog she posted two days ago, one of her followers left a comment asking how she managed to forgive her husband.
“I’m genuinely curious how you healed the loss of your son in your marriage and forgave your husband. No hate,” the comment read.

The influencer responded saying that healing is not the key to dealing with grief.
“You don’t heal from the loss, you learn to live with the grief. Lots of therapy and consistency,” she said.
“As well as the realization that everyone deserves love, empathy and forgiveness. And that you don’t have to worry about the opinions of others, which therapy helps with.”
She also responded to another comment in December, asking if her family was upset with Brady over the toddler’s death.

Emilie returned to TikTok in August 2025 with a lengthy statement about the loss of her son.
“A loss of this magnitude is impossible to put into words,” the influencer wrote.
‘I’ve been trying to find them for days, weeks, months [the right words] and also taking the time I need to process the loss of my baby.”
“Trigg is our baby and our best friend. The light and spirit he brought into this world was bright, pure, joyful and unmistakable.
“We miss him every second of every day and carrying on often feels unbearable,” Emilie wrote.
“I never thought we would experience grief like this or the pain of losing him so suddenly. It is a pain, heartache and emptiness that no family should ever have to endure.”
The couple also share an 11-month-old son, Theodore.
Trigg Kiser, who was featured heavily on his mother’s TikTok and Instagram videoswas found unconscious in the backyard pool of the family’s Arizona home on May 12.
Emilie was not home at the time of the incident, but her husband Brady was home with Trigg and their youngest son.
Brady reportedly lost track of Trigg while caring for their newborn.
According to police reports, Brady placed a $25 sports bet on an NBA playoff game around the time of the incident.
According to the police report, Trigg tripped and fell into the water while playing with an inflatable chair.

Investigators say he was unattended in the backyard for nine minutes, seven of which he was in the water.
When Brady discovered his son at the bottom of the pool, he put his newborn son down and dove in to retrieve him before immediately beginning CPR. He then called the emergency services.
When police arrived on the scene, they took over CPR and Brady was said to be “completely panicking” and “extremely distraught”.
At one point, Brady called Emilie and was said to be “inconsolable” on the phone as he told her what happened and that she needed to come home.
Emilie, who was reportedly at a taco restaurant near their home, was driven straight to the hospital by a friend to meet her son.
The toddler was taken to the hospital in critical condition and sadly died on May 18, which was confirmed by the Maricopa County Medical Examiner.
The family pool had a cover that was not on at the time of the incident because the pool needed maintenance the next day, according to the report.

In a lengthy emotional statement on Instagram, Emilie later reminded parents to “watch their children at all times,” adding that “no amount of supervision is too much or ‘helicopter parenting.’”
She urged parents to register children for swimming lessons and asked people to ensure they have a good physical barrier, such as a fence around their pool.
In Australia, pool fences are required by law, with different states having different standards and requirements.
“Take all possible precautions around water with your children,” Kiser wrote.
“Drowning is quick and preventable.”
Emilie said she took “full responsibility” for her son’s death in a statement shared online in August, saying that “one of the hardest lessons I carry with me is that a permanent pool fence could have saved his life.”
