TikTok influencer Emilie Kiser has filed a lawsuit to keep records of her three-year-old son’s death private.
Kiser, 26, filed the legal proceedings against multiple public offices in Maricopa County in the US state of Arizona as police continue to investigate the death.
Her son Trigg died on May 18, six days after he was pulled unconscious from a backyard pool.
The social media influencer, who has a TikTok following of 4 million, filed the suit over privacy concerns as they navigate their grief.

“Emilie and her family desperately want to grieve in private, but sadly the public will not let them,” the suit obtained by Rochester First reads.
“Trigg’s death has become a media frenzy.”
The lawsuit claims 100+ public record requests have been filed to City of Chandler and the Maricopa County Medical Examiner’s Office for details on Trigg’s death which the lawsuit refers to as a “heartbreaking accidental drowning”.
Kiser also has a two-month-old son Theodore with husband Brady Kiser.
”Emilie is trying her best to be there for her surviving son, two-month-old Theodore. But every day is a battle,” the suit reads.

Attorneys are pleading with the court on Kiser’s behalf to prevent the “profound invasion of privacy that would result from the public disclosure of these sensitive materials”.
The suit hopes for the court to prevent Maricopa County public offices from granting “public access to any investigative or post-mortem records related to the tragic death of her son, Trigg.”

A number of municipal offices have been named as defendants in the suit, including the city of Chandler, the Chandler Police Department and Maricopa County.
“When Maricopa County learned the family was pursuing a court order to prevent the release of these records, the Office of the Medical Examiner worked with the family to place a seal on the record,” Maricopa County director of communications, Jason Berry, recently told NBC News.
Trigg Kiser, who features heavily on his mum’s TikTok and Instagram videos, was found unconscious in the backyard pool on May 12.
Police were called to a home in Phoenix last Monday, after reports of a drowning where Trigg was found unconscious, and was given CPR until paramedics arrived.
The toddler was rushed to hospital in a critical condition and sadly died on May 18, which was confirmed by the Maricopa County medical examiner.
“Our thoughts and deepest condolences are with the child’s family and loved ones during this unimaginable time,” read the statement issued on behalf of the local police.

She and her husband, Brady, became parents in July 2021 when they welcomed their son Trigg and more recently welcomed their second child, another son Theodore, in March.
The social media influencer hasn’t posted on her platform since May 13.
