Maddison Bain jailed for fatal hit-run of Kelly T’Hart, which prompted change to WA law

A drunk driver who left a woman dead has been sentenced to almost five years behind bars for the incident that prompted a change in driving behavior. Western Australia‘s laws.
Kelly T’Hart was described as the rock of her family, but the 32-year-old’s life was cut short almost two years ago when she was struck and killed while walking near Mandurah, about 45 miles south of Perth.

Maddison Bain was on bail and behind the wheel, driving on the unlit Furnissdale road with a standard speed limit of 70mph.

Her blood alcohol level was later calculated as four times the legal limit.

Her friend in the backseat with a three-month-old baby had told her to drive more carefully and shouted, “F— Maddie, you just hit someone.”

But the 27-year-old continued home, leaving T’Hart face down in the mud.

The incident prompted T’Hart’s family to lobby for a change in the law that would prevent hit-and-run drivers from getting back on the road while out on bail.

“No drinking and driving, it doesn’t take anything to take an Uber or call a friend or family member,” T’Hart’s mother, Susan T’Hart, said outside the courtroom today.

“Don’t do this to other people and kill someone you love.”

Bain wiped tears from her eyes as the victim’s mother read her statement, but she showed much more emotion when her own children were mentioned.

The court heard she became pregnant while waiting for her case to be heard.

Bain was today sentenced to four years and eleven months in prison and banned from driving for three and a half years.

“She would be very proud, as would all of us,” family friend Denyse Needham said outside court.

“It’s a wonderful legacy for such a beautiful girl.”
